  1. APPLICABILITY

These general terms and conditions apply to all offers, agreements, and services of mithra.network. By using our platform or by purchasing our hardware and/or services, you agree to these terms.

  1. SERVICES AND INFRASTRUCTURE

Platform: mithra.network provides a digital infrastructure for data management and IoT connectivity. Availability: We strive for an uptime of 99.9%, but cannot guarantee uninterrupted service due to the nature of internet and telecommunications infrastructures. Maintenance: We reserve the right to temporarily suspend services for scheduled maintenance. This will be communicated in advance whenever possible.

  1. DATA SOVEREIGNTY AND OWNERSHIP

Customer Data: All data generated by the customer's devices remains the exclusive property of the customer.

License: The customer grants mithra.network a limited, non-exclusive license to process this data, solely for the purpose of providing and improving the services.

Anonymization: We may use anonymized, aggregated data for statistical purposes and network optimization.On what legal basis do we process your data?

We process your data based on one or more of the following legal grounds from the GDPR:

  • Consent: when you actively sign up or fill out a form.

  • Performance of a contract: when we issue an offer or provide services.

  • Legitimate interest: for commercial communication within a business context, and for improving our website and advertisements.

  • Legal obligation: if applicable.

  1. HARDWARE AND INSTALLATION

If hardware is delivered, the risk of loss or damage passes to the customer upon delivery. The customer is responsible for the proper installation and environmental conditions (power supply, physical security) of all equipment on-site, unless otherwise agreed in a Service Level Agreement (SLA).

  1. PAYMENT AND SUBSCRIPTION

Costs are invoiced in accordance with the agreed quote or subscription plan. Late payment: Payments not received within 30 days of the invoice date are subject to statutory interest and may lead to suspension of services.

  1. LIABILITY

Indirect damages: mithra.network is not liable for indirect damages, including lost profits, loss of data, or business interruption. Liability cap: Our total liability is limited to the amount paid by the customer for the specific service during the 6 months prior to the event that caused the damage.

  1. INTELLECTUAL PROPERTY

All software, algorithms, and branding related to mithra.network remain the intellectual property of mithra.network or its licensors. Users may not reverse-engineer or decompile our software.

  1. APPLICABLE LAW

These terms are governed by Dutch law. Disputes shall be submitted to the competent court in the district where mithra.network is established.
